Land Survey & Strata Plan
There has been much debate over the years about the meaning of the various easements shown on our strata plan and where the boundary of 2-4's land actually was, both on the east and the west sides. Finally in November 2017 we had a comprehensive survey carried out of the land and its boundaries.
The picture above shows the land boundary marked in yellow paint. The pink dashed line on the left shows the extent of a right of carriageway for 6-8 Farrell and the pink dashed line on the right shows the extent of a right of carriageway for 2-4 Farrell. Note: the distances from the walls of the buildings to the painted lines are clearly stated on the surveyor's plan.
The fence of our neighbours to the west, The Horizon, is built some 1 metre to the west of the actual boundary (where it meets Farrell Avenue) and follows the line of the old fence of the ABC Radio car park (which was demolished to build The Horizon) gradually becoming wider down to the north boundary. On the day of the survey, the owner of lot 2 refused to open the sliding gate on the front fence of lot 2 to allow the surveyors to get a line of sight down the west side, but they were able to accurately mark the line of the boundary on the front footpath and the rear retaining wall.
The surveyors written report and site diagram is given here with some photographs taken a month or so later.
An old draft agreement with 6-8 Farrell as to parking on the driveway is given below, though I don't believe the 3 month trial was ever extended:
